Terms and Conditions for registration to droidcon India 2025 & Fluttercon India 2025
  1. Scope
    1.1 The following Terms and Conditions for registration to droidcon India 2025 & Fluttercon India 2025 conference (together hereinafter  referred to as “Event”) of Messe Berlin India Pvt. Ltd. , Unit No. 812, 8th Floor, Emaar Capital Tower – 1, MG Road, Sikanderpur, Sector 26, Gurgaon – 122 002 Haryana, India (hereinafter referred to as “MB India”) apply with regard to the purchase of admission tickets (hereinafter referred to as “Ticket(s)”) or to the registration of visitors, sponsors, speakers or partners  (jointly hereinafter also referred to as “Attendee”) for the Event.

1.2 With the purchase of the Tickets or the registration of the Attendee, the purchaser of the Ticket (hereinafter also referred to as “Customer”) or the registering Attendee accepts these terms and conditions for registration to droidcon India 2025 & Fluttercon India 2025 (hereinafter referred to as “Terms and Conditions”).

1.3 Counter-confirmations by the Customer referring to the Customer´s own business or purchasing conditions are hereby expressly contradicted. They should also not apply if MB India has not explicitly objected to their validity and/or provides its services without an objection. Deviations from these Terms and Conditions shall only be effective if they have been confirmed in writing by MB India.

1.4 MB India, Customer and Attendee are hereinafter referred to as “Contractual Party/Parties” depending on the context.

  1. Ticket Sales / Registration
    2.1 MB India uses the platform of KonfHub, a product of KonfHub Pvt. Ltd., 91 Springboard, 45/3, Gopalakrishna Complex, Museum Road, Bengaluru, Karnataka – 560025, India (hereinafter referred to as “KonfHub”) to sell tickets or register Attendees in the Event.

2.2 The agreement for the purchase of Tickets (hereinafter also referred to “Purchase Agreement”) shall be concluded between MB India and the Customer as follows:
MB India offers the Customer various ticket categories via the official event website (https://india.droidcon.com/tickets/). The Customer will be forwarded to the official website of KonfHub (hereinafter referred to as “Ticket Website”). After entering the requested order data (ticket buyer data, tax receipt, billing information, attendee information, and working information), the Customer accepts the contractual offer by clicking the “Proceed Payment” button. Hereby, Customer confirms these Terms and Conditions and takes note of the data protection information of MB India .

2.3 Sponsor, Speaker, or Partner will receive an access code to be entered at the Ticket Website. The Tickets will be either free of charge or a negotiated discount will apply. Sponsor, Speaker, or Partner with a free of charge or a discounted ticket will be asked to enter the requested Attendee data and to confirm these Terms and Conditions as well as to take note of the data protection information of MB India.

  1. Confirmation, Tickets
    3.1 After booking and fulfilling its payment obligation, the Customer or registered Attendee will receive a confirmation e-mail from KonfHub with the Mobile Ticket. Admission to the Event is granted exclusively with this Mobile Ticket.
    3.2 The resale of Tickets is prohibited. In the event of a breach of the above provision, MB India shall inter alia be entitled to block the Ticket in question and refuse to allow the ticket holder to participate in the Event without compensation, shall also refuse to sell Tickets to the person concerned in the future and to issue a ban on entering the premises.
  1. Prices, payments
    4.1 The current prices for the respective ticket category can be seen on the Ticket Website and are displayed when selecting the type and number of Tickets to be purchased. The prices quoted on the Ticket Website at the time the order is placed shall apply. The statutory value-added tax is shown on the ticket shop if applicable.
    4.2 Unless otherwise agreed, the Customer shall pay the amount stated in the Customer’s order by the means of payment chosen. The payment shall be made through the payment gateway integrated with the Ticket Website. The Customer agrees and accepts that all nuances and modalities relating to making payment using Internet Banking/ Debit/Credit Cards/etc. (“Virtual Payment Mode”) shall be separately governed by arrangement(s) / terms and conditions between Customer and the relevant banks/ payment gateway service providers. We shall not be responsible, in any manner whatsoever, for any liability that may arise in relation to the Virtual Payment Modes. While availing any of the payment method(s) available on the Ticket Website, MB India will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to Customer due to (a) lack of authorization for any transactions; (b) any payment issues arising out of the transaction or (c) decline of such transaction for any reason. 4.3 The purchase price for the Tickets is due for payment immediately and without deductions after the conclusion of the Purchase Agreement. Partial or installment payments are not permitted. The fulfillment of the Customer’s payment obligation only occurs with crediting to one of the bank accounts of KonfHub.
    4.4 In the case the payment by the Customer fails before the Event starts, MB India reserves its right to cancel the registration and assert further claims. The Customer or registered Attendee thereby loses its right to participate. Neither MB India nor KonfHub shall be liable for any costs incurred by the Customer or Attendee as a result of non-registration or cancellation of registration due to non-payment.

 

  1. Right of cancelation
    5.1 MB India grants Customer or registered Attendee a right of cancelation until 30 days before the Event´s start day. To cancel its participation in due time, the Customer or registered Attendee must send an e-mail to global@droidcon.com. Decisive for determination of the timely receipt of the notice of cancelation is the date of receipt.
    5.2 If the right of cancelation is effectively exercised, the relevant Ticket(s) will be blocked so that entry to the respective Event will not be possible. In the event of cancelation having become effective and the relevant Ticket(s) was/were ordered and paid for by credit or debit card, the refund will automatically be credited to the Customer´s credit or debit card account.
  1. Liability, Force Majeure
    6.1 MB India shall be liable for all damage caused by intent or gross negligence of MB India, its legal representatives, executives or vicarious agents on whatever legal ground.

6.2 MB India shall be liable for damages in cases of simple negligence, subject to limitations of liability by statute (e.g. care and diligence in relation to one’s own affairs), only

  1. a)   for damage arising from injury to life, limb or health,
  2. b) for damage arising from breach of a Material Contractual Obligation. “Material Contractual Obligations” are obligations the very discharge of which is a prerequisite for the proper performance of the contract and on the discharge of which the other Party to the contract can, as a rule, rely. In the event of breach of Material Contractual Obligations, the obligation of MB India to provide damages shall be limited as to the amount in cases of simple negligence to the damage foreseeable upon conclusion of this agreement that typically occurs.

6.3 To the extent that the liability of MB India is excluded or limited, this also applies to the vicarious agents and legal representatives of MB India as well as any other service provider acting on behalf of MB India.

6.4 The foregoing exclusions and limitations of liability shall not apply in cases of negligent injury to life, limb or health of persons for which it is responsible, expressly guaranteed qualities.

6.5 MB India shall not be responsible for disturbances, delays and/or damage caused by force majeure, in particular natural phenomena.

  1. Postponement / Cancellation of the Event
    7.1 If an event is postponed, the Tickets for the new event date automatically remain valid. A rewriting/replacement is not required. Expenses and further costs will not be reimbursed.
    7.2 Tickets may not be returned or refunded unless the Event is canceled without replacement. In this case, MB India will reimburse the costs actually incurred for the Ticket. Expenses and further costs will not be reimbursed.
  1. Special conditions for congresses, seminars, workshops, meetings, and conferences
    8.1 MB India reserves the right to replace announced speakers with others and to make necessary changes to the event program and venues while preserving the overall character of the Event. If it is not possible to organize a part of the Event due to force majeure, the absence of a speaker, disruption at the Event, or a low number of attendees, the Attendees will be informed immediately.
    8.2 Event-related lectures and documentation are protected by copyright and may not be reproduced, distributed, or commercially used in any form – not even in part – without the consent of MB India and the respective speakers. All film and sound recordings intended for the duration of the Event require the prior permission of MB India. Photographs are not permitted. MB India assumes no responsibility or liability whatsoever for any inaccuracies in the content of the lectures and documentation or for their conformity under trademark and copyright law.
    8.3 MB India works to create a comprehensive overview of the interactions and events that may be of promotional interest to the Event. Accordingly, please be advised that you may be filmed or photographed at any time and any presentations you deliver may be recorded. If you do not wish to be filmed, photographed, or recorded, please advise MB India and/or legal representatives and/or vicarious agents beforehand.
  1. Data protection
    9.1 MB India, and where applicable its authorized service partners, shall collect, process, and use personal data in accordance with the provisions of the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (India), and, where applicable, the European Union General Data Protection Regulation (EU GDPR) (jointly also referred to “Data Protection Laws”). The data shall be processed solely for legitimate purposes, including but not limited to, providing support and information to current and prospective customers, and for the performance and administration of services offered in relation to the Event.

9.2 The Attendee expressly agrees that MB India may store, process, and transmit personal data (including data processed by automated means) for purposes connected to the Attendee’s participation in the Event, including pre- and post-event communications, customer support, and service coordination. Such processing shall be carried out on the basis of contractual necessity, legitimate interest, or express consent, in accordance with applicable Data Protection Laws.

9.3 MB India shall retain personal data only for as long as necessary to fulfil the purposes for which it was collected, or to comply with statutory obligations, whichever is longer. Personal data will not be used for any unrelated purpose without prior consent unless permitted under applicable Data Protection Laws.

9.4 The Attendee expressly consents to the transfer and disclosure of its contact information (including name, telephone number, email address, and fax number) to third-party service providers engaged by MB India, strictly for the purpose of facilitating the Attendee’s participation at ITB India and enhancing related services. Any such third

party shall be contractually bound to ensure compliance with applicable data protection requirements and adopt appropriate technical and organizational measures to safeguard the data.

9.5 Where personal data is transferred outside India or the European Economic Area (EEA), such transfers shall be undertaken in compliance with applicable laws, ensuring an adequate level of protection as required under the DPDPA or GDPR, including through standard contractual clauses or other recognized transfer mechanisms.

9.6 The Attendee may withdraw consent at any time with future effect by notifying MB India. Such withdrawal shall not affect the lawfulness of processing carried out prior to the withdrawal.

  1. Visa Requirements

10.1 It is the sole responsibility of the Attendee to take care of his/her visa requirements. Attendees who require an entry visa must allow sufficient time for the application procedure. Attendees should contact the nearest embassy or consulate to determine the appropriate timing of their visa applications.
10.2 MB India will not directly contact embassies and consulates on behalf of visa applicants.

  1. Miscellaneous

11.1 In addition to these Terms and Conditions, the House Rules of the exhibition grounds, shall apply, in particular concerning access to events and halls, participation in the Event, and public safety and order at MB India.
11.2 Should individual provisions of these Terms and Conditions be ineffective, the validity of the remaining provisions shall not be affected. The invalid provision shall be amended in such a way that the intended purpose is achieved.
11.3 The prevailing laws of the Republic of India shall apply exclusively with the exclusion of the UN Convention on Agreement for the International Sale of Goods.
11.4 The place of fulfillment of the contractual obligations under this Agreement shall be Bangalore, India.

11.5 Any dispute or difference whatsoever arising between the Contractual Parties out of or relating to the construction, meaning, scope, operation or effect of this Agreement or the validity or the breach thereof shall be settled by arbitration in accordance with the Rules of Arbitration of the Indian Council of Arbitration and the award made in pursuance thereof shall be binding on the Contractual Parties. Due to its reputation as a preferred arbitration venue, the Parties have chosen the seat of arbitration as New Delhi. The proceedings shall be conducted in the English language.
